Y.E.S & MOMO PTY LTD trading as Happy Cap Studio (ABN: 16 677 946 413) is a registered company in Australia. By visiting a Happy Cap Studio location or using our portable photo booth hire service, you agree to the following terms. Please read them before your session or booking.
1 In Store Studio Use
1.1 Walk in policy
· Happy Cap Studio operates on a fully walk-in basis. We do not accept reservations for in-store sessions.
· We recommend arriving at least 15 minutes before closing to allow sufficient time to complete your session. All booths will be shut down at the end of operating hours.
1.2 Operating Hours
· Our operating hours may vary between locations. Staffed hours also vary. Please check our website or Instagram for the most up-to-date hours before visiting.
1.3 Eligibility
· Our studios are open to all ages. Visitors under 12 years of age must be accompanied by an adult. By entering the photobooth, you confirm you have read and agree to these terms.
1.4 Sessions & Payment
· Payment is required upfront before each session begins. All services must be paid in full at the time of the session.
· We accept card and cash. Please follow the on-screen prompts at the payment terminal.
· All transactions are final. Refunds are only issued where a technical fault prevents your session from completing.
· Session time begins once the machine is activated. We are not responsible for time lost due to user error or indecision.
· Coupon redemptions that do not include a code must be presented and verified during staffed hours. We are unable to process these retrospectively or during unstaffed periods.
1.5 Use of the Studio
· Please treat the studio space, booth, and props with care. Damage caused by misuse may result in a charge to cover repair or replacement costs. Where damage is substantial, we may also seek compensation for loss of income on a case-by-case basis.
· Food and drink are not permitted inside the photo booth.
· Maximum occupancy inside the booth is 10 people at a time.
· Please follow all on-screen prompts and posted instructions. Do not attempt to repair or adjust equipment yourself – contact us immediately if something seems wrong.
· We reserve the right to refuse entry or end a session without refund if a visitor is behaving in a manner that is unsafe, disruptive or harmful to equipment, staff or other guests.
1.6 Technical Issues
· If the machine fails to complete your session due to a technical issue, we will offer a complimentary re-session or full refund.
· Minor imperfections such as slight colour variations due to auto exposure or white balance settings are normal and do not qualify as a technical issue.
· In the event of a significant defect (e.g. print misalignment or equipment malfunction), please notify us on-site or contact us within 72 hours of your session. We will review each case individually and may offer a complimentary session or partial/full refund.
· Physical prints are provided directly after your session. Please handle them with care. Happy Cap Studio is not liable for damage to prints after they have been received.
· If a print is left behind by the customer or on the wall, we may display these on the store walls or in browsing locations within the store.
1.7 Digital Copies
· Digital copies are provided as a complimentary service via QR code at the end of your session.
· Digital files are available for download for 72 hours after your session. We strongly recommend that you download them promptly.
· After 72 hours, digital copies are automatically deleted from our systems and cannot be retrieved.
1.8 Your Photos & Privacy
· By using our studio you grant Happy Cap Studio with permission to use photos taken on-site for marketing purposes (e.g. social media, website).
· Digital photos are unable to be accessed by our staff.
1.9 CCTV Surveillance
· CCTV cameras are in operation at all times at our studio locations to ensure customer safety and prevent vandalism.
· By entering our premises, you consent to video monitoring. Footage is stored securely and accessed only when necessary.
· CCTV footage is used solely for security purposes and will not be shared externally except as required by law.
1.10 Personal Belongings
· Please keep personal items secure while using our booths. Happy Cap Studio is not responsible for any lost, stolen or damaged personal belongings.
1.11 Code of Conduct
· We are committed to maintaining a positive, welcoming environment for all guests.
· Any form of harassment, inappropriate behaviour or disrespectful conduct toward staff or other customers will not be tolerated and may result in removal from the premises.

2 Portable Hire
2.1 Bookings & Deposits
· A non-refundable deposit of 50% of the total booking fee is required to confirm your booking.
· The remaining balance is due 30 days prior to your event date.
· Bookings are not confirmed until the deposit has been received and you have received written confirmation from us.
2.2 Cancellations & Changes
· Cancellations made more than 14 days before the event: deposit is forfeited; no further charge.
· Cancellations fewer than 14 days before the event: 100% of the total booking fee is payable.
· Date changes are subject to availability and must be requested in writing at least 14 days before the original event date. One date change is permitted at no additional cost.
· Happy Cap Studio reserves the right to cancel a booking in exceptional circumstances (e.g. equipment failure, safety concerns). In such cases a full refund will be issued.
2.3 Event Requirements
· The client is responsible for providing a suitable space: minimum 2m x 2m floor area, access to a standard 240V power outlet, and a flat, stable surface.
· Access to the venue for setup must be available at least 60 minutes before the hire period begins.
· Outdoor hire is available subject to weather conditions. Happy Cap Studio reserves the right to relocate or cease operation if conditions pose a risk to equipment or staff.
· Travel fees apply for venues outside of a 30km radius of Sydney CBD. These will be quoted at time of booking.
2.4 Operation & Staffing
· A Happy Cap Studio attendant will be present for the duration of your hire period to operate the booth and assist guests.
· The hire period begins and ends at the agreed times. Additional time may be available at an additional hourly rate, subject to availability and agreement on the day.
· The client is responsible for the behaviour of their guests around the equipment. Damage caused by guests will be charged to the client.
2.5 Prints & Digital Files
· Unlimited print sessions are included during the hire period, subject to paper supply. In the unlikely event of a supply issue, digital-only sessions will continue.
· A digital gallery of all session photos will be provided to the client within 5 business days of the event.
· Custom frame designs must be submitted and approved at least 7 days before the event.
2.6 Liability
· Happy Cap Studio is not liable for any loss, damage, or injury arising from use of the portable booth by guests, except where caused by our own negligence.
· The client agrees to indemnify Happy Cap Studio against any claims arising from the event where we are not at fault.
· Our liability is limited to the total value of the booking fee paid.
3 Frame Events
This section sets out the terms that apply when a Artist or brand collaborates with Happy Cap Studio to create a frame design and accompanying assets (“Frame”) for use within our photobooth systems and promotional materials. Three tiers are available with different obligations as set out below.
Tier 1 – Happy Cap Commissioned
This tier applies where Happy Cap Studio has engaged and paid the Artist to create the Frame.
3.1 Purpose
· Happy Cap Studio commissions the Artist to create an original Frame for use within its photobooth systems and promotional materials.
· The Artist will deliver original frame artwork to Happy Cap Studio’s required format and specifications.
· Happy Cap Studio will manage all upload, testing, alignment checks and system configuration.
3.2 Payment & Delivery
· Commission fee and payment terms will be agreed in writing prior to commencement.
· The Artist must deliver all required assets (frame design, thumbnail, poster artwork) by the agreed deadline
· Payment will be made upon deliver and approval of final assets unless otherwise agreed.
3.3 Rights – Commissioned
· Upon payment, Happy Cap Studio is granted full, permanent, irrevocable and exclusive rights to the Frame and associated assets.
· Happy Cap Studio may use, display, reproduce, modify, distribute and promote the Frame across all platforms, locations and channels without restriction or further consent or compensation to the Artist.
· These rights are permanent and survive the end of any collaboration period.
· The Artist may not reproduce, publish, display, licence or submit the commissioned Frame to any other party at any time.
· The Artist retains ownership of their broader body of work and underlying artistic style, but not of the commissioned Frame itself.
· Happy Cap Studio will credit the Artist at its discretion. Credit is not a condition of use.
3.4 Artist Obligations – Commissioned
The Artist agrees to:
a. Deliver the original frame design(s) in the required format and specifications.
b. Deliver a thumbnail in the required format and specifications.
c. Deliver a static poster for in-store and digital display.
d. Ensure all designs are original and do not infringe on any third-party rights.
e. Not reproduce, publish or submit the commissioned Frame to any other party.
Tier 2 – Collaboration (no payment exchanged)
This tier applies where both parties agree to collaborate at no cost – the Artist provides a Frame Design at no charge, and Happy Cap Studio provides in-store placement and promotional exposure at no charge.
3.5 Purpose – Collaboration
· The Artist provides an original Frame for use within Happy Cap Studio’s photobooth systems and promotional materials.
· Happy Cap Studio provides in-store placement, credit and promotional exposure.
· No money is exchanged by either party under this tier.
3.6 Rights – Collaboration
· The Artist retains full ownership of the original artwork
· The Artist grants Happy Cap Studio a non-exclusive, royalty free licence to use, display, print and promote the Frame for the duration of the agreed collaboration period.
· Happy Cap Studio may use the Frame in stores, on machines, on printed posters, and across digital and online promotional platforms during the collaboration period.
· Happy Cap Studio will not sell or independently monetise the Artist’s design without a separate written agreement.
· Happy Cap Studio and Artist logos or watermarks will remain visible and unobstructed on frame outputs.
3.7 Artist Obligations – Collaboration
The Artist agrees to:
a. Deliver the original frame design(s) in the required format and specifications.
b. Deliver a thumbnail in the required format and specifications.
c. Deliver a static poster for in-store and digital display.
d. Ensure all designs are original and do not infringe on any third-party rights.
e. Not licence, sell or submit the same Frame design to any other photobooth provider or similar service during the collaboration period.
3.8 Happy Cap Studio Obligations – Collaboration
a. Handle all upload, testing, alignment checks and system configuration for the Frame
b. Provide technical feedback to the Artist if adjustments are required
c. Print promotional posters featuring the Frame for in-store display
d. Credit the Artist in promotional channels
e. Ensure Happy Cap and Artist logo/watermarks remain visible and unobstructed on frame outputs.
3.9 Collaboration Period & Removal
· The collaboration period will be agreed in writing between both parties prior to the Frame going live.
· Either party may request removal of the Frame with reasonable written notice. Happy Cap Studio will remove the Frame from active use within 7 days of receiving such a request.
Tier 3 – Custom Frame Upload (Charged to the Requestor)
This tier applies where an Artist, brand or individual pays Happy Cap Studio to display their own frame design within our photobooth systems for an agreed period.
3.10 Service & Pricing
· Custom frame upload is available at Burwood and/or Melrose Park in-store locations.
· Pricing covers upload, testing, alignment checks and display for the agreed period. Additional locations are charged separately.
· The display period will be agreed in writing at the time of booking.
· Frame designs must be submitted in the required format and specifications prior to upload. Happy Cap Studio will provide these specifications upon request.
3.11 Rights – Custom Upload
· The Collaborator retains full ownership of their Frame Design at all times.
· By submitting a design the Collaborator grants Happy Cap Studio a limited, non-exclusive licence to display and use the Frame solely within the agreed locations for the agreed display period.
· Happy Cap Studio will not use the Collaborator’s design for any other purpose, modify it, or display it beyond the agreed scope without written permission.
· Happy Cap Studio will not claim ownership of or rights over the submitted design.
3.12 Collaborator Obligations – Custom Upload
The Collaborator agrees to:
· Submit original artwork in the required format and specifications by the agreed deadline.
· Ensure the design is their own original work and does not infringe on any third-party rights.
· Not hold Happy Cap Studio liable for minor technical variations in how the frame renders in the booth environment.
3.13 Refunds – Custom Upload
· Fees are non-refundable once the frame has been uploaded and activated.
· If Happy Cap Studio is unable to display the frame due to a technical issue, a full refund or complimentary display extension will be offered.
4 Privacy & Data
Happy Cap Studio only collects personal information necessary to process your booking or session. We do not sell or share your personal data with third parties for marketing purposes.
5 Changes to these Terms
We may upload these terms at any time. The current version will always be available at happycapstudio.com/terms. Continued use of our services after any update constitutes acceptance of the revised terms. We are under no obligation to notify customers individually of changes.
